Draft Gujarat Shops and Establishments (Registration of Employment and Conditions of Services) Rules, 2019

The State Government of Gujarat on October 03, 2019, has published the Draft Gujarat Shops and Establishments (Regulation of Employment and Conditions of Service) Rules, 2019.

The Draft Rules will be taken into consideration by the State Government of Gujarat after expiry of thirty days of its publication in the Official Gazette (October 03, 2019).

Whereas, employer of every establishment engaging tenor more workers shall submit application in Form-A for registration of the establishment along with the required documents. The application may be submitted online where online access is available.

The employer of every establishment engaging less than ten employees shall submit an intimation in Form-D of commencement of the business along with the required documents. The intimation may be submitted online where online access is available.

Further, it specifies the procedure for cancellation of Registration Certificate by Inspector; Submission of notice to make changes in Registration Certificate in Form-G; procedure for informing the closing of business to Inspector in Form- H and I; conditions for employment of women in nigh shifts; Notice of weekly holidays; Prohibition of overlapping of shifts; provisions related to latrines and urinals, cleanliness, lighting and ventilation, Creche, canteens, etc.; Maintenance of Registers and Records; Annual returns.

The objection and suggestions may be sent to Additional Chief Secretary, Labour and Employment Department, Block no. 5, 6th floor, New Sachivalaya, Gandhinagar with the period of thirty days as mentioned above.
