DPIIT notifies the Patents (Amendment) Rules, 2019

The Department of Promotion of Industry and Internal Trade (DPIIT) on September 17, 2019, has notified the Patents (Amendment) Rules, 2019.

However, the Patents (Amendment) Rules, 2019 amends the Patents Rules, 2003. Some of the major amendments in the Patents Rules, 2003 are as under:

Ø  Under Rule 6 which specifies the procedure for serving or leaving documents at the patent office, sub-rule (1A) has been substituted, namely:

Sub-rule (1A): Notwithstanding anything contained in sub-rule (1), a patent agent shall file, leave, make or give all documents only by electronic transmission duly authenticated:

Provided that any document, if asked to be submitted in original, shall be submitted within a period of fifteen days, failing which such documents shall be deemed not to have been filed.

Ø  Under Rule 7 which specifies the fees payable for grant of patents, in sub-rule (1) second proviso has been substituted, namely:

Provided further that in the case of a small entity, or startup, every document, for which a fee has been specified, shall be accompanied by Form-28.
